Intellectual Property Litigation.
Some of the most important assets in today’s society are
not tangible. Rather, they are intellectual property such as those
protected by copyrights, trademarks, patents, and the laws governing
trade secrets. Fee & Jeffries regularly both prosecutes and defends
clients in a wide variety of intellectual property disputes both
pre-suit and in litigation.
n
Copyright litigation–Copyrights
protect the rights to reproduce, distribute, and use an original
created expression or work, be it architectural, artistic, dramatic,
literary, musical, or even sculptural. Fee & Jeffries has
represented clients in copyright cases involving architectural
drawings for residential and governmental facilities, business
forms, commercial artwork, computer code, and even pantomime
performances. Depending upon whether and when the work in question
was registered with the United States Copyright Office, a prevailing
party in a copyright infringement action may recover actual or
statutory damages, costs, and attorneys’ fees.
n
Trademark and trade dress litigation–Generally
speaking, trademarks are appearances, designs, words, slogans,
symbols, or even distinctive sounds that parties use to identify and
distinguish their goods and services from those of others. A
closely-associated concept is trade dress, which is when the
product’s appearance itself is sufficiently distinctive to identify
its source, such as the classic Coca-Cola® bottle shape. Our firm’s
attorneys are experienced in representing clients in trademark and
trade dress litigation involving a wide range of products and
services, including famous-brand watches, HVAC equipment,
restaurants, toys and leisure products, religious organizations,
home improvement services, and solar-energy devices.
n
Patent litigation–The attorneys
of Fee & Jeffries represent our clients in protecting their patented
inventions and processes and also defend our clients against claims
of patent infringement. In patent disputes, we assist our clients
in identifying and retaining licensed patent counsel with particular
expertise in the field of the inventions at issue to provide us with
assistance on technical scientific and engineering issues. We
believe that our clients are best served by such a team approach.
By virtue of this tailored patent litigation team, our clients enjoy
the benefits of both seasoned litigators and hand-picked patent
counsel.
n
Trade Secret litigation–Many of
our clients have developed information databases, processes, and
technologies that, while not eligible for other forms of
intellectual property protection, are extremely valuable. Items
such as customer lists, market analysis, and technical manufacturing
processes are often protectable trade secrets. We regularly
represent our clients in trade secret litigation and have
significant experience in obtaining and defending against
injunctions, which is often sought in such cases. |
